摘要:人民陪审员制度是我国民主政治的重要组成部分，是人民群众参与国家管理的重要形式，是加强司法监督的重要保障机制。目前，我国人民陪审员制度仍存在许多不足：如人民陪审员制度的适用范围不明确、人民陪审员的选任制度不够完善、人民陪审员的权利和义务不明确、人民陪审员的任期和考核制度出现职业化、人民陪审员“陪而不审”等。本文通过对国外陪审制度的比较与借鉴，提出了完善我国人民陪审员制度的建议。完善我国的人民陪审员制度，有利于维护司法公正、推进司法民主、加强司法监督、防止司法腐败，也有利于维护诉讼当事人的合法权益。

Abstract:The people's jury system is an important part of Chinese democratic politics，it is also an important form for the masses to participate in the national management and an important safeguard mechanism to strengthen judicial supervision. At present, many deficiencies still exist in the people's jury system, such as the scope of people's jury system is not so clear, the selection system of people's juror is not perfect, the rights and obligations of people's jury are not clear, the term and assessment of the people's jury appear to be professional, and people's jury accompany without trial, etc. In this paper, through the comparison and reference of the foreign jury system, we put forward suggestions to improve our people's jury system. Perfecting the people's jury system, is conducive to maintaining the judicial justice, judicial democracy, strengthen judicial supervision, to prevent judicial corruption, but also conducive to the maintenance of the legitimate rights and interests of the litigants.
