【摘要】在我国当前行政实践中,公务员滥用权力的现象层出不穷,违法事件频频发生。这一现象久治不愈的真正原因在于公务员实际上的权力过大,而义务相对较小,权力与义务失衡。将公务员纳入行政赔偿主体,确立行政赔偿中国家和公务人员为共同赔偿责任主体,变内部追偿为外部共同赔偿,使公务员的责任外部化,能切实落实公务员因故意和重大过失而承担的责任,从而更好的监督其依法行政,促进社会的和谐发展。

【Abstract】In China's current administrative practice, the phenomenon of abuse of power, civil servants endless violations occur frequently. Long treatment of this phenomenon is actually the real reason is that the power of the civil service is too large, and relatively small obligations, rights and obligations of balance. Taking the Civil Servent into Excutive Compensation, to establish executive compensation in the state and public officials liability for the common subject, change the internal recourse to external common compensation, outside of the responsibilities of civil servants, civil servants can effectively implement the intent and gross negligence and liability, To better monitor its administration according to law, and promote harmonious development of society.
