摘要:在当今精神文明和物质文明都空前发展的时代，我国的死刑制度在立法和司法上虽然取得很大进步，但仍存在着一些问题。本文通过对外国死刑制度的对比研究与借鉴，提出完善我国死刑制度的建议：废除绝对确定的法定刑、确定死刑判决的统一标准、完善死刑复核程序、增加死刑犯赦免制度、完善死刑缓期执行制度、死刑执行方式向人道性发展。完善我国的死刑制度，有利于促进我国刑事法治进步，有利于促进我国人权事业的发展，有利于促进社会和谐稳定。

Abstract:Nowadays，with unparalleled development of both material and ethical civilization，our country's system has made a great progress on legislation and judiciary. But there still have a few problems in death penalty. This article conducts a comparative study by checking foreign death penalty system，so as to submit a suggestion of perfecting our country's death penalty system：Abolishing the legal punishment which is ascertained absolutely，making a unified standard for the death sentence，perfecting the procedure for the review of death sentence，improving the death penalty pardon system，perfecting the death suspension system，developing the death execution towards humanity. By improving the death penalty system of our country，it is beneficial for boosting criminal rule and law of our country as well as promoting the development of human rights in our country，and improving the  social stability.
