摘要:在市场经济飞速发展的今天,劳动力市场化的进程超过了其他生产要素市场化的过程,劳动争议的数量也呈逐年上升的趋势。建立和谐的劳动关系已经成为构建社会主义和谐社会不可回避的艰巨任务。在和谐劳动关系建立的法律因素中,劳动争议处理制度具有独特的程序价值,应当体现促进劳动关系和谐的精神,有助于释放争议劳动关系中的紧张因素,公正、及时地化解劳动争议,降低当事人耗费和社会成本。我国劳动争议处理机制中的调解、仲裁和诉讼三种方式在有其合理性的同时都存在着缺陷,这对于劳动争议的处理是不利的,因此需要从制度、程序等方面对其进行完善,形成“裁审分离,各自终局”的劳动争议处理模式。

Abstract:On the say when the market economy is developing rapidly, the course of the labor market has exceeded the course of other factor markets and the amount of the labor dispute is also going up year after year, so to establish the harmonious labor relation has become the hard task that can not be obviated for constructing the harmonious socialistic society. In the law factor of establishing the harmonious labor relation, the settlement of labor dispute system has its special program value, so it should show the spirit of advancing the labor relation, should help the strain factor in releasing the labor dispute relation, should dissolve the labor dispute equitably and duly and depress the use and cost of one party. The three ways, the intercession, the intermediation and the litigation used in our Chinese dealing with the labor dispute have their rationality but also have the limitation at the same time and can not meet the practical request of the development of the labor relation. Therefore, it needs to be perfected from the system and program and try to form the labor dispute managing mode that the arbitrament is separated from the examination and each manages its own scope.

我国的劳动争议处理方式包括调解、仲裁和诉讼都各自存在着缺陷,无论是在制度上,还是在程序上。这已经不能适应现代经济发展和劳动关系调整的需要。针对我国的劳动争议处理方式存在的缺陷,按照上述完善途径,最后建立“裁审分离,各自终局”的劳动争议处理方式,可以更好的适应劳动关系发展的现实需要,更好的处理劳动争议,有利于促进和谐劳动关系的建立。
