摘要:家庭冷暴力问题在我国已经引起了社会的普遍关注，但还未对其赋予足够的重视，故笔者对家庭冷暴力的法律界定、特点、表现形式、现状、发展趋势、成因、危害以及解决途径进行较为全面系统的研究。通过借鉴其它国家和地区的相关规定，结合我国的具体情况，为更好地设计家庭冷暴力制度提供理论上的依据。笔者建议：建立一套有效的家庭冷暴力的社会干预机制，健全我国反家庭冷暴力的法律规制，完善家庭冷暴力的司法救济解决路径。

Abstract:In our country，the problem of family cold violence has already raised widespread attention in society. But people have not placed enough attention on it. So the author do more comprehensive and systematic researches on the legal definition, characteristic, form of expression, present situation, development trend, gnensis, harm, settle a way of the family cold violence. Through absorbing experience and lessons from the relative developed countries and districts, combined with the specific situation in our country, in order to offer the theoretical basic for designing the system of family cold violence better, the author suggests, to establish a set of effective community intervention mechanism of cold violence in family, building of our anti-family violence law regulation, perfecting cold violence judicial remedy solutions.

　　　家庭是社会最基本的细胞，只有家庭的安宁才有社会的稳定。然而目前无论是发达国家还是发展中国家，都存在着不同程度的家庭暴力问题。而随着社会的不断发展，家庭冷暴力正日益成为破坏现代婚姻家庭的病毒，而我国的相关法律法规对家庭冷暴力没有明确规定，现在应当将对家庭冷暴力的研究提上议事日程。冷暴力也叫精神暴力，它的伤害与身体暴力相比虽然不见血，但其伤害程度不亚于身体暴力。正确界定家庭冷暴力，了解其成因、法律特点和解决途径，对于有针对性地预防家庭冷暴力，构建和谐家庭，推动社会进步，具有重要意义。
