摘要：《刑法修正案（八）》将醉酒驾驶机动车这一行为入罪，对酒驾起到震慑作用，但是此条文从条文解释到条文适用上还存在着大量问题。本论文通过研究醉驾入刑的立法上存在的缺陷及司法困境，通过对本国法律法规及外国相关法律的分析，提出了解决酒驾问题的法律及其他对策。

Abstract:The “Criminal law Bill for amendment (Eight)” punished the behavior of alcoholic intoxication driving vehicle, has the frightens function to alcoholic intoxication driving, but this article still has the massive problems from article explained to article appropriate used. The present paper is through research the legislation flaw and the judicial difficulty about drunk driving into the punishment, through analysis our country laws and regulations and the foreign related laws, put forward the law and other countermeasures to solve the question about alcoholic intoxication driving.

　　　我国在世界上堪称“酒乡”，“酒”是中国多年来的历史文化传统，喝酒是人们谈心交往的辅助物品。同时社会、经济的迅猛发展，带动了汽车产业的发展与产业量的大大提升。在我国，汽车产业是重要的支柱产业，在国民经济和社会发展中起着重要的作用，汽车的人均拥有量大幅上升，但每年因各种交通安全事故造成的人员和财产损失更是触目惊心。酒文化的根深蒂固，无可避免地出现喝酒后驾车的情况，致使交通事故频繁发生，人员伤亡惨重，酒后驾驶在当今社会已经成为一种难以遏制的现象。
