【摘要】当今社会环境污染和生态破坏现象日趋严重，如何以法律手段更为有效地对其进行遏制与预防，是本文写作的初衷。目前我国环境侵权补偿性赔偿具有局限性，在环境侵权赔偿制度中引入惩罚性赔偿就显得尤为必要。惩罚性赔偿制度除了制裁功能、威慑功能、激励功能之外，能更好的对受害者进行补偿。本文将论证惩罚性赔偿在环境侵权中如何适用，同时对惩罚性赔偿的适用范围、适用条件、赔偿数额等提出具体的构建设想。

【Abstract】Today the phenomena of environmental pollution and ecological disruption are becoming more serious,How to contain and prevent it,it is the authors intention of writing this essay.In the current system of Environmental Liability,the compensatory damages has its limitation, so introduction of the punitive damages is particularly necessary. Environmental tort punitive damages in addition to the sanctions function, deterrence function, excitation function, the more important is that it better to compensate the victims.This article will argue that how the punitive damages use in the environment, At the same time put forward some ideas about the scope of punitive damages, the suitable conditions, the amount of compensation.
