[摘要]权责失衡是指权利和责任在运行过程中出现的脱钩现象,有权无责较为普遍。而“政府本位”、“全能政府”、“法律法规存在漏洞和缺陷”、“暗箱行政”等等是造成行政权责失衡的主要原因,由此引发了一系列不良后果,例如对经济效益的盲目追求、民主政治建设中“人本”意识的弱化。消除行政权责失衡,实现行政权责对等和一致,关键要彻底转变政府职能,实现政府责任法定化;深化政务公开,扩大监督主体知情权;健全行政执法责任制。

[Abstract] Power imbalance is that rights and responsibilities in the operation process of decoupling, power without responsibility is more common. " The government standard"," omnipotent government"," legal loopholes and defects"," camera obscura administration" and so on is caused by administrative power the main causes of the imbalance, which causes a series of adverse consequences, such as the economic benefits, the blind pursuit of democratic political construction in "person this" consciousness weakening. To eliminate the administrative authority duty unbalance, realize the equal rights and responsibilities and consistent, the key to complete the transformation of government functions, government responsibility legal realization; deepening open, expand the main body of supervision right of knowing; perfect the responsibility system of administrative enforcement of law.

  构建社会主义和谐社会是我们追求的共同理想,以人为本的价值系统在和谐社会构建中具有突出重要性,具体表现为:化解各种利益矛盾的现实需求;善待自然、社会关系的客观要求;扩大社会发展成果受益范围的必然诉求;明确和谐社会构建主体的实践要求。而实现以人为本的管理前提必须充分重视“人性化”的管理理念,因此我们要克服行政管理过程中各种违背人性的管理理念和方法,并通过法律途径将人性化的管理策略确定下来。
